1. Introduction & Acceptance of Terms

What this means for you

Welcome to Amy Wecker MD LLC. These Terms of Service lay out the ground rules for using our website, scheduling appointments, and receiving care. By booking a visit or browsing our site, you're agreeing to these terms — so please take a few minutes to read through them. We've written them to be as clear as possible.

These Terms of Service (the "Terms") constitute a legally binding agreement between you ("Patient," "User," or "you") and Amy Wecker MD LLC, doing business as SoBe Functional Medicine ("SoBe Functional Medicine," "Practice," "we," "us," or "our"). These Terms govern your access to and use of the SoBe Functional Medicine website, patient portal, telemedicine platform, and all healthcare services provided by the Practice.

These Terms apply to:

  • Current and prospective patients receiving in-person or telehealth care;
  • Visitors to the Amy Wecker MD LLC website; and
  • Users of the Practice's secure patient portal or any affiliated digital platform.

By accessing our website, creating a patient account, scheduling an appointment, or receiving services from Amy Wecker MD LLC, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

SoBe Functional Medicine serves patients who are 18 years of age or older. We do not provide services to individuals under the age of 18.

2. About Amy Wecker MD LLC

What this means for you

We are a functional medicine practice — meaning we focus on finding and addressing the root causes of health concerns, not just managing symptoms. We offer in-person visits right here in Miami Beach as well as telehealth consultations. That said, we are not an emergency care provider. If you have a medical emergency, please call 911 immediately.

Amy Wecker MD LLC is a functional medicine practice located in Miami Beach, Florida. Our clinical approach is grounded in integrative, whole-person care that identifies and addresses the underlying causes of disease and dysfunction. We combine evidence-based medicine with personalized lifestyle, nutritional, and therapeutic interventions to support long-term health and wellness.

Our services include, but are not limited to:

  • In-person consultations and follow-up visits at our Miami Beach location;
  • Telehealth and telemedicine consultations via secure, HIPAA-compliant video conferencing for patients physically located in Florida, Virginia, Georgia, or South Carolina;
  • Comprehensive laboratory testing and results interpretation;
  • Personalized wellness programs, nutritional counseling, and lifestyle medicine; and
  • Coordination with specialists and referral management.

Dr. Amy Wecker, MD holds active medical licensure in Florida, Virginia, Georgia, and South Carolina. Telehealth services are available to established and prospective patients who are physically located in one of these states at the time of their appointment. Patients located outside of these licensed states are not eligible to receive telehealth services through this practice until appropriate licensure is obtained.

Important — Emergency Care Notice

Amy Wecker MD LLC is not an emergency care provider and does not provide emergency medical services. If you are experiencing a medical emergency — including but not limited to chest pain, difficulty breathing, severe injury, signs of stroke, or any other life-threatening condition — please call 911 immediately or go to your nearest emergency room. Do not wait for a telehealth or in-person appointment with our practice.

3. Telehealth Services

What this means for you

We offer secure video visits so you can meet with your provider without always needing to come into the office. There are a few important rules: you must be physically located in Florida, Georgia, South Carolina or Virginia during the visit, you'll need a working camera and internet connection, and you'll sign a separate telehealth consent form. Telehealth is convenient, but it has limits — your provider may ask you to come in if a situation calls for an in-person exam.

3.1 Definition of Telehealth

For purposes of these Terms, "telehealth" means the use of synchronous or asynchronous telecommunications technology, as defined under Florida Statute §456.47, to provide health care services and education, including consultations, diagnosis, treatment planning, patient monitoring, prescription of medications (where permitted), and health-related education. Asynchronous telehealth refers to the store-and-forward of medical data; synchronous telehealth refers to real-time audio/video interaction between patient and provider.

3.2 Licensure & Geographic Scope

Dr. Amy Wecker, MD is licensed to practice medicine in the following states: Florida, Virginia, Georgia, and South Carolina. Telehealth services are available to patients who are physically located in one of these states at the time of their appointment. Patients located outside of these states are not eligible to receive telehealth services through this practice until appropriate licensure is obtained.

3.3 Patient Location Requirement

You must be physically located within a state in which Dr. Amy Wecker, MD holds an active medical license (currently Florida, Virginia, Georgia, and South Carolina) at the time of any telehealth visit. Delivering care to patients located outside of these licensed states may violate applicable interstate licensing laws. By scheduling a telehealth appointment, you confirm and warrant that you are physically present in one of these states at the time of service. If you are not located in a covered state, please notify the Practice before your appointment so we may appropriately reschedule or assist you in finding care in your current location.

3.4 Standard of Care

Our providers will deliver telehealth services consistent with the scope of practice authorized under Florida, Georgia, South Carolina or Virginia law and in accordance with the prevailing professional standards applicable to functional and integrative medicine. The same standards of care that apply to in-person visits apply to telehealth consultations.

3.5 Prescribing Limitations

Consistent with Florida, Georgia, South Carolina and Virginia law and applicable federal regulations, Amy Wecker MD LLC will not prescribe Schedule II controlled substances via telehealth, except in circumstances expressly permitted under Florida law and applicable DEA regulations. Our practice's approach to functional medicine generally does not involve controlled substance prescribing, and we will always discuss medication considerations openly with you during your care.

3.6 Technology Requirements

To participate in a telehealth visit, you are responsible for ensuring that you have:

  • A stable, high-speed internet connection sufficient to support live video;
  • A device equipped with a functioning camera and microphone (smartphone, tablet, or computer);
  • A private, reasonably quiet environment to protect the confidentiality of your visit; and
  • Access to the telehealth platform link or application provided by the Practice prior to your appointment.

The Practice is not responsible for technical difficulties arising from your equipment, internet service, or software. If a visit cannot be completed due to technical issues on your end, it may be treated as a late cancellation or rescheduled at the Practice's discretion.

3.7 Risks and Limitations of Telehealth

You acknowledge that telehealth services, while convenient and effective for many purposes, carry certain inherent limitations when compared to in-person care. These may include, without limitation:

  • Inability to perform physical examination maneuvers;
  • Potential for reduced diagnostic accuracy in the absence of direct examination;
  • Technology failures that may interrupt or degrade service quality; and
  • Limitations on the range of services that can be provided remotely.

Your provider retains the clinical discretion to determine, at any time, that an in-person evaluation is necessary or clinically appropriate. In such cases, the provider will advise you accordingly and assist in scheduling an in-person visit.

3.8 Separate Telehealth Consent

Your informed consent to receive telehealth services is obtained separately via the Practice's Telehealth Consent Form, which you will be asked to sign prior to your first telehealth visit. These Terms supplement, but do not replace, that consent. In the event of any conflict between the Telehealth Consent Form and these Terms regarding telehealth services specifically, the Telehealth Consent Form shall control.

4. Scope of Services & Medical Disclaimer

What this means for you

Functional medicine is integrative and preventive — it works alongside, not instead of, emergency or urgent care. The articles and information on our website are educational resources, not personalized medical advice. A formal patient-provider relationship begins only after you complete intake and are accepted as a patient.

The services provided by Amy Wecker MD LLC are integrative and complementary in nature, designed to work in coordination with your broader healthcare team. Our services are not intended to replace, and should not be used as a substitute for, emergency medical care, acute hospital care, or any other medical services for which you should consult an appropriately licensed and qualified healthcare professional.

Medical Disclaimer. The information, content, and materials published on the Amy Wecker MD LLC website — including blog articles, educational resources, newsletter content, and social media posts — are provided for general informational and educational purposes only. Such content does not constitute medical advice, diagnosis, or treatment recommendations, and should not be relied upon as a substitute for professional medical advice specific to your individual health circumstances.

No Patient-Provider Relationship via Website. Browsing our website, reading our content, submitting an inquiry form, or following our social media channels does not, by itself, establish a physician-patient or provider-patient relationship between you and Amy Wecker MD LLC. A formal patient-provider relationship is established only upon:

  • Completion and submission of the Practice's new patient intake forms;
  • Written or verbal acceptance of you as a patient by the Practice; and
  • Provision of a clinical service, consultation, or treatment recommendation to you by a licensed provider of Amy Wecker MD LLC.

Prior to the establishment of a patient-provider relationship, no information shared via the website, email inquiry, or contact form should be interpreted as professional medical guidance.

5. Appointments & Scheduling

What this means for you

You can book appointments online through our patient portal, via email, by completing the contact us form on our website or by calling us directly. New patients need to complete their intake paperwork before their first visit — this helps us make the most of your appointment time together. Occasionally, we may need to reschedule, and we'll always give you as much notice as possible.

5.1 How to Book

Appointments may be scheduled through the Amy Wecker MD LLC secure patient portal or by contacting the Practice directly by email or phone during regular business hours. Appointment availability is subject to provider schedules and clinical capacity.

5.2 New Patient Intake Requirements

All new patients are required to complete the Practice's intake forms and documentation — including health history questionnaires, consent forms, and any required insurance or payment authorization forms — prior to the date of their first appointment. Failure to complete required intake documentation at least 24 hours before a scheduled new patient appointment may result in rescheduling of that appointment. Completed intake information allows your provider to deliver informed, personalized care from the very first visit.

5.3 Practice Right to Reschedule or Cancel

Amy Wecker MD LLC reserves the right to reschedule or cancel appointments in circumstances including, but not limited to, provider illness, administrative necessity, or operational emergencies. In such cases, the Practice will make reasonable efforts to provide you with advance notice and to offer an alternative appointment at the earliest available time. The Practice will not charge cancellation or no-show fees for appointments cancelled or rescheduled by the Practice.

6. Cancellation & Refund Policy

What this means for you

Life happens — we get it. We just ask for at least 24 hours' notice if you need to cancel or reschedule. Late cancellations and no-shows take time that another patient could have used. For refunds, services already delivered are non-refundable, but if you've pre-purchased a package and haven't used all sessions, we'll review refund requests fairly. Emergencies are always considered individually.

6.1 Cancellation Notice Requirement

To cancel or reschedule an appointment without financial penalty, you must provide at least 24 hours' advance notice prior to your scheduled appointment time. Cancellations may be made via the patient portal, by phone, or by email to the Practice's designated contact address.

6.2 Late Cancellation Fee

Cancellations made less than 24 hours before a scheduled appointment may be subject to a late cancellation fee. The applicable fee amount will be communicated to you at the time of scheduling and/or in the Practice's intake documentation. The Practice reserves the right to waive this fee at its sole discretion in extenuating circumstances.

6.3 No-Show Policy

A "no-show" occurs when a patient fails to attend a scheduled appointment without providing any prior notice of cancellation. No-show appointments may be charged a no-show fee equivalent to a portion of or the full cost of the scheduled service. Repeated no-shows may result in restrictions on future scheduling or, at the Practice's discretion, termination of the care relationship in accordance with Section 9 of these Terms.

6.4 Refund Policy

The following refund guidelines apply:

(a) Services Rendered: Fees for services already performed are non-refundable, except in cases of documented billing error or at the Practice's express discretion.

(b) Lab Fees: Fees for laboratory testing are generally non-refundable once laboratory orders have been placed, as costs are incurred at the time of ordering.

(c) Medical Emergencies: Cancellation and no-show fees may be waived for documented medical emergencies. Such requests will be reviewed on a case-by-case basis and may require supporting documentation.

Refund Request Process

To dispute a fee, please submit your request in writing to the Practice's billing contact within 7 days of the relevant charge. Include your name, date of service, and a brief explanation of your request. We will respond within a reasonable timeframe.

7. Payment & Billing

What this means for you

Amy Wecker MD LLC operates as a direct-pay practice, meaning we do not bill insurance companies directly. Payment is expected at the time of your visit. You may use your HSA or FSA card. If you'd like an estimate of costs before your appointment, just ask — we're happy to provide one under the federal No Surprises Act.


7.1 Payment at Time of Service

Payment for all services is due at the time of service, unless prior written arrangements have been made with the Practice's billing department. The Practice reserves the right to require prepayment or a deposit for certain appointment types, packages, or laboratory orders.

7.2 Direct-Care / Cash-Pay Practice

Amy Wecker MD LLC operates as a direct-care, cash-pay practice. We do not accept assignment from, and do not bill directly to, health insurance carriers, including Medicare or Medicaid, for our services. You are solely responsible for payment of all fees at the time of service. Upon request, the Practice may provide you with a superbill or receipt that you may submit to your health insurer for possible out-of-network reimbursement. We make no representations regarding whether your insurer will reimburse any portion of our fees, and we encourage you to verify your out-of-network benefits directly with your insurance carrier before your appointment.

7.3 Accepted Payment Methods

The Practice currently accepts the following forms of payment:

  • Major credit and debit cards (Visa, Mastercard, American Express, Discover);
  • Health Savings Account (HSA) cards; and
  • Flexible Spending Account (FSA) cards.

Additional payment methods may be accepted at the Practice's discretion. Please contact us for the most current list of accepted payment options.

7.4 Returned Payments / NSF Fee

In the event that a payment is returned, declined, or reversed for any reason (including insufficient funds), the Practice may assess a returned payment fee and will require immediate resolution of the outstanding balance. Repeated payment issues may affect scheduling privileges.

7.5 Good Faith Estimate — No Surprises Act

In accordance with the federal No Surprises Act (42 U.S.C. §300gg-111 et seq.) and applicable implementing regulations, uninsured or self-pay patients have the right to receive a Good Faith Estimate of expected costs prior to scheduled services. If you are uninsured or choosing not to use insurance for your care at Amy Wecker MD LLC, you may request a Good Faith Estimate at any time before your appointment. Please contact our billing department to request one. You have the right to dispute a bill that exceeds your Good Faith Estimate by $400 or more through the federal patient-provider dispute resolution process.

8. Privacy & HIPAA Compliance

What this means for you

Your health information is protected by federal law (HIPAA), and we take that seriously. We have a full Notice of Privacy Practices (NPP) that explains your rights in detail. We will never sell your information or use it for marketing without your explicit permission. Our website uses basic analytics cookies, but those are separate from your medical records.

8.1 HIPAA & Protected Health Information

Amy Wecker MD LLC is a covered entity under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its implementing regulations (45 C.F.R. Parts 160 and 164). All Protected Health Information (PHI) collected, used, or disclosed by the Practice is governed by HIPAA and by the Practice's Notice of Privacy Practices (NPP), which is incorporated into these Terms by reference. You will receive a copy of the NPP upon enrollment as a patient. A current version is also available upon request from the Practice.

8.2 Website Cookies & Analytics

The Amy Wecker MD LLC website may use cookies, web beacons, and third-party analytics tools (such as website traffic analytics) to understand how visitors interact with our site and to improve user experience. Information collected through website analytics is not PHI and is not connected to your medical record. For detailed information on how we use cookies, please review our separate Privacy Policy available on our website.

8.3 Electronic Communications

The Practice provides a secure patient portal for communications that may contain PHI. You acknowledge and understand that electronic communications sent outside of the secure patient portal — including standard email, text messages, and voicemail — may not be fully encrypted and may carry a risk of interception by unauthorized third parties. By choosing to communicate with the Practice via these unencrypted channels, you assume the associated risks. We encourage use of the secure patient portal for all health-related communications.

8.4 No Sale of PHI for Marketing

Amy Wecker MD LLC will not sell, rent, trade, or otherwise disclose your PHI to any third party for marketing purposes without your explicit prior written authorization, as required under HIPAA and applicable Florida law. Any use of your health information for communications beyond treatment, payment, and healthcare operations will be conducted only with your separate, written authorization.

9. Patient Responsibilities

What this means for you

A great healthcare partnership is a two-way relationship. We ask that you give us accurate, complete health information, let us know about any changes in your health, and follow through on the care plan we develop together. We're committed to treating you with respect — and we ask for the same in return for our entire team.

9.1 Accuracy of Information

You are responsible for providing Amy Wecker MD LLC with accurate, complete, and current information about your health history, current medications and supplements, known allergies, prior diagnoses, prior treatments, and any other information reasonably relevant to your care. Providing inaccurate or incomplete information may adversely affect the quality of care you receive and may constitute a breach of these Terms.

9.2 Notification of Changes

You agree to promptly notify the Practice of any material changes in your health status, medications or supplement regimen, emergency contact information, or insurance and payment information. Timely updates are essential to ensuring your care plan remains accurate and safe.

9.3 Participation in Care

Functional medicine is a collaborative and participatory model of care. You are responsible for actively engaging in your health journey, which includes following through on care plan recommendations, completing recommended laboratory testing, attending scheduled follow-up appointments, and pursuing referrals to other providers as recommended by your Amy Wecker MD LLC provider. The Practice cannot guarantee clinical outcomes where recommended care steps are not followed.

9.4 Respectful Conduct

Amy Wecker MD LLC is committed to maintaining a safe, respectful, and welcoming environment for all patients, staff, and providers. You agree to treat all Practice personnel with courtesy and respect. The Practice reserves the right to terminate the care relationship with any patient who engages in abusive, threatening, discriminatory, or otherwise disruptive conduct toward staff, providers, or other patients. In the event of care termination for conduct reasons, the Practice will provide you with reasonable advance written notice and will assist in transitioning your care to another appropriate provider to avoid patient abandonment, in accordance with applicable Florida law and ethical standards.

10. Intellectual Property

What this means for you

The content on our website — articles, guides, logos, graphics — belongs to us. You're welcome to read and use it for your own health education, but please don't copy, republish, or sell it without our written permission. The patient portal is for your personal use only.

All content published on the Amy Wecker MD LLC website, patient portal, and associated platforms — including but not limited to text, articles, blog posts, educational guides, graphics, logos, photographs, and branding materials — is the exclusive intellectual property of Amy Wecker MD LLC or its licensed content providers, and is protected by United States copyright, trademark, and other applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use website content for your personal, non-commercial health education purposes only. You may not, without the prior written consent of Amy Wecker MD LLC:

  • Reproduce, copy, or distribute Practice content for any commercial purpose;
  • Modify, adapt, translate, or create derivative works based on Practice content;
  • Publicly display or republish Practice content on any other platform or medium; or

The patient portal is provided for your personal use in managing your care relationship with Amy Wecker MD LLC. Access to the portal may not be shared with or transferred to any other individual.

What this means for you

Our website may link to external resources — supplement companies, lab partners, or articles we find useful. We're sharing these as helpful references, but we're not responsible for what happens on those third-party sites. Each has its own terms and privacy policies.

These links are provided for informational and convenience purposes only. Amy Wecker MD LLC does not control, endorse, sponsor, or assume responsibility for the content, accuracy, privacy practices, or terms of any third-party websites or services.

Third-party service providers that the Practice may utilize in connection with your care — including but not limited to independent laboratory partners, dietary supplement vendors, telemedicine platform providers, and billing service providers — are independent entities. Your use of their platforms or services is governed by their own respective terms of service and privacy policies, not these Terms. The Practice encourages you to review the terms and privacy policies of any third-party service you engage with in connection with your care.

Any purchases, agreements, or transactions made with third-party vendors or service providers are solely between you and that third party. Amy Wecker MD LLC is not a party to such transactions and bears no liability in connection with them.

12. Limitation of Liability

What this means for you

This section places reasonable limits on our financial liability in the event of a dispute. It's standard language in most healthcare service agreements. Importantly, nothing here protects the Practice from liability for genuine negligence or intentional misconduct — your rights in that regard are fully preserved.


12.1 Limitation on Damages

To the fullest extent permitted by applicable Florida law, Amy Wecker MD LLC's total cumulative liability to you arising out of or relating to these Terms or the services provided hereunder — regardless of the form of action, whether in contract, tort, strict liability, or otherwise — shall not exceed the total amount of fees actually paid by you to the Practice for the specific service or services that are the direct subject of the claim.

12.2 Exclusion of Certain Damages

To the fullest extent permitted by applicable law, Amy Wecker MD LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with these Terms or the services, including but not limited to loss of revenue, loss of data, loss of business opportunity, or costs of substitute services, even if the Practice has been advised of the possibility of such damages.

12.3 Exceptions

Nothing in these Terms shall operate to limit or exclude Amy Wecker MD LLC's liability for:

  • Gross negligence or willful misconduct on the part of the Practice or its providers;
  • Fraud or fraudulent misrepresentation; or
  • Any liability that cannot be lawfully limited or excluded under applicable Florida or federal law, including applicable medical malpractice statutes.

Your statutory rights under Florida law and applicable federal healthcare regulations are not affected by these Terms.

13. Dispute Resolution & Governing Law

What this means for you

If a dispute ever arises, we want to resolve it together first — just talk to us. If we can't reach an agreement through conversation, disputes will go to binding arbitration in Miami-Dade County. This is a neutral, private process. You always retain the right to file a complaint with the Florida Department of Health about any licensing concerns.


13.1 Governing Law

These Terms, and any dispute arising out of or relating to them or the services provided by Amy Wecker MD LLC, shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles.

13.2 Informal Resolution

Before initiating any formal dispute resolution process, the parties agree to first attempt to resolve any dispute through good-faith direct negotiation. You agree to contact the Practice in writing at the address listed in Section 1 of these Terms to describe the nature of your dispute and your desired resolution. The Practice will respond within a reasonable time. This informal step is required prior to commencing arbitration, except in cases where interim injunctive relief is necessary to prevent irreparable harm.

13.3 Binding Arbitration

If a dispute is not resolved through informal negotiation within 30 days of the written notice described in Section 13.2, the dispute shall be submitted to final and binding arbitration administered by the American Arbitration Association (AAA) under the AAA Health Care Payor Provider Arbitration Rules, or such other AAA rules as may be applicable. The arbitration shall be conducted in Miami-Dade County, Florida, unless otherwise agreed by the parties. The arbitrator's decision shall be final and binding, and judgment upon the award rendered by the arbitrator may be entered in any court of competent jurisdiction. This arbitration agreement does not apply where prohibited by applicable law.

13.4 Class Action Waiver

To the fullest extent permitted by applicable law, you and Amy Wecker MD LLC agree that any dispute resolution proceeding will be conducted on an individual basis only. You agree to waive any right to bring or participate in any class action, mass arbitration, or representative action against the Practice. If this waiver is found unenforceable in a particular case, that case shall be excluded from arbitration and resolved in a court of competent jurisdiction.

13.5 Right to File Regulatory Complaints

Nothing in these Terms — including the arbitration and class action waiver provisions — limits your right to file a complaint or report with the Florida Department of Health, any applicable professional licensing board, the U.S. Department of Health and Human Services Office for Civil Rights (regarding HIPAA matters), or any other applicable regulatory authority.

14. Modifications to These Terms

What this means for you

Healthcare law and best practices evolve — and so may these Terms. We reserve the right to update them, and we'll notify you of meaningful changes via email or your patient portal. If you keep using our services after an update, that means you've accepted the new version.

Amy Wecker MD LLC reserves the right to modify, update, or replace these Terms at any time, at its sole discretion, to reflect changes in law, changes in practice operations, or other developments. The most current version of these Terms will always be available on our website and, upon request, from the Practice directly.

For material changes to these Terms — changes that meaningfully affect your rights or obligations — the Practice will use reasonable efforts to notify active patients via email to the address on file or via a notice in the patient portal, at least 14 days prior to the effective date of the change, where practicable.

Your continued use of the Practice's website, patient portal, or services after the effective date of any updated Terms constitutes your acceptance of those updated Terms. If you do not agree to updated Terms, you should discontinue use of the Practice's services and notify us in writing. Discontinuation of services is subject to any applicable care transition procedures.
